Care plan terms

The deal, in plain language.

Effective 19 July 2026. This page is the whole agreement between you and Forma Sites. No separate contract, nothing hidden in a PDF you never got sent.

Forma Sites builds and looks after websites for fitness businesses in New Zealand. "We" and "us" means Forma Sites, run by Hamish, a sole trader. "You" means whoever's business the site is for. This applies from the day your site goes live on a care plan.

What you get

A live, fast, mobile friendly website, hosted and looked after by us. Small updates whenever you need them: text, images, prices, hours, done for you, not by you. Security, backups and uptime handled. Nothing for you to manage or maintain.

What it costs

A flat monthly care plan, agreed with you before anything goes live. Founding rate is NZ$29 a month for early clients, locked in for as long as you stay, standard rate is NZ$39 a month after that. An annual option is available at NZ$290 a year, two months free against the monthly rate.

No build fee. No setup fee. The design itself has always been free, that never changes once you're live.

Small updates included

Text, image, price and content changes are part of your plan, turned around within 2 business days as standard. If we miss that on a normal request, that turnaround delay is on us, not chased against your plan. New pages, new features, a booking system, or a full redesign are a separate job, always quoted in writing before any work starts, always your call whether to go ahead. Typical range for that kind of work is from NZ$150.

You own everything

Your website and your domain are yours, registered in your name or handed to you if we register it for you. If you ever leave, we hand over your files and point your domain wherever you ask, within a reasonable time. No lock in, no holding your site hostage, ever, regardless of how or why you leave.

Cancelling

Month to month, no minimum term. Cancel any time by emailing hello@formasites.com. Your current paid period runs out in full, we don't cut the site early, and you are not charged again after that. We don't refund the part of a month already paid for, the same as any other monthly service.

If you're on the annual plan and cancel partway through the year, the remaining months are not refunded. The annual price is a prepaid discount in exchange for the year up front, the same logic as any annual plan anywhere. If that ever feels wrong for your situation, email us, we'll talk about it like people rather than hide behind this page.

If a payment fails

Card declines happen, expired cards, banks flagging something, it's normal. Stripe automatically retries a failed payment over roughly two weeks. We'll email you the first time it happens so you can update your card if needed. Your site stays live during that window. If payment still can't be collected after that, we'll reach out directly before anything is paused, we don't pull a site without warning you first.

What we promise, and what we don't

We promise: a genuinely good site, kept live, current and working, best effort uptime, and if something breaks on our side, we fix it fast at no extra charge.

We don't promise: a specific number of bookings, a revenue figure, or a Google ranking. Those depend on far more than a website, and anyone who guarantees them is not being straight with you. We're responsible for the site. The business outcome is still yours to build, we just remove the website as an excuse.

Privacy

If your site has an enquiry form, the details a visitor sends go to you, and only you. We don't sell, rent or repurpose them. We don't run third party ad trackers on client sites. Basic hosting logs exist the way they do for any website on the internet, that's infrastructure, not tracking.

Liability

If something goes wrong on our side, our responsibility is limited to the fees you've paid us in the 12 months before the issue. That's a fair ceiling for a NZ$29 to $39 a month plan, and it's standard for a service at this price, not us trying to dodge something.

Your rights under New Zealand law

Nothing on this page takes away any right you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where those Acts apply and can't legally be excluded, they aren't excluded by this page, regardless of anything else written above.

Changes to these terms

We may update this page occasionally as the business grows. If a change materially affects you, we'll email you before it takes effect rather than letting you find out by accident.

Governing law

This agreement is governed by the laws of New Zealand.
